Selling Policies and Rules

1.    SELLING ON CRAFT IS ART

You must be 18 years or older to become a seller on Craft is Art. Individuals under the age of 18 can become sellers under the supervision of a parent or legal guardian, the latter becomes responsible for all activities. Craft is Art reserves the right to remove any items, cancel invalid accounts and stores, and to refuse service to anyone for any reason at any time.

2.    LISTINGS

General Rules

  1. When Craft is Art accepts a listing on this Site, it does so without exclusivity. Seller is permitted to sell such listed item on its own after paying all applicable listing fees.
  2. Once an item is sold, seller is obligated to pay Craft is Art the applicable current sales commission.
  3. If Craft is Art believes that a seller has incorrectly priced an item, Craft is Art may remove the listing.
  4. The listing may include text descriptions, graphics and other content relevant to the sale of the item. Craft Is Art in its sole discretion reserves the right to terminate any listing without notice.
  5. By listing an item you agree to comply that the item being listed and the information provided comply with Craft is Art's policies and that you may legally sell the item.
  6. All listings on Craft is Art must be for a tangible object.
  7. The item description should be clear, accurate and detailed.
  8. Each listing must describe accurately and completely the item(s) for sale.
  9. Listings that do not comply with Craft is Art's policies may be removed without notice.
  10. You may not edit a listing's information to change it to an entirely different item; this is considered fee avoidance.
  11. Members who do not comply with Craft Is Art’s policies may be subject to review, which can result in suspension of account privileges and/or termination.

Allowed Items

  1. Items that are Handmade
    We allow you to sell items that are handmade by you, a group or anyone who used their own unique methods and techniques to create an item, this may include individuals or groups with production assistance for certain intermediary tasks.
     
  2. Items that are Not Handmade
    These types of items should be marked as "Not Handmade" and should not be branded (it must not have a brand or trademark) and should fit the concept of "Crafts and Arts" as well as fit under the main categories of Craft is Art. You can see the current complete list at http://www.craftisart.com/categories.
     
  3. Supplies
    All types of supplies (commercial and non-commercial) are allowed and they should fit under the subcategories of the main category "Supplies" or be useful in the creation of items (handmade or non-handmade) that can be found for sale on Craft Is Art.
     
  4. Vintage
    Vintage items must be 20 years or older and may be items that are unaltered or have been repaired or restored to their original condition.
     
  5. Commercial Items
    Commercial items are allowed as long as they are not branded. See “Branded Items” under “Prohibited and Restricted Items” for more information.

Prohibited and Restricted Items

  1. Adult Items (Mature Content)
    Sexually-oriented adult material is meant for people who are 18 years and older. We allow the sale of this material, but you can only list these items in the Everything Else > Adult Only category.

    Allowed

    • Mature content is defined as: visual depiction of male or female genitalia, sexual activity or content, profane language or graphic violence.
    • Item listings containing mature content must be tagged with "Mature”.

    Restricted

    • The first thumbnail image in your item listing should be kept appropriate for general audiences; additional images in the listing may show the item in its entirety. Mature content and/or profane language or images are only allowed starting from the second photo and on of an item listing and the description text of a listing.

    Prohibited

    • Pornography is prohibited.

     
  2. Alcohol
    In general, Craft Is Art does not allow the sale of alcoholic beverages on its website. Other items related to alcohol beverages such as Beer/wine making kits and raw materials are allowed.

    Allowed

    • Beer/wine making kits
    • Foods with alcoholic ingredients and flavoring (such as liquor-filled chocolates, rum cake, and other items) as long as the item complies with our food policy
    • Hops, seeds for hops, and other raw materials to make beer or wine.

    Restricted

    • Empty alcohol bottles and containers (images in the listing must show item is empty)

    Prohibited

    • Alcohol products intended for consumption


  3.  Animals, Live Animals and wildlife products
    These listings are strictly prohibited on Craft Is Art
     
  4. Branded Items
    Items that may be identified by name, term, design, symbol, or any other feature that identifies one seller's good or service as distinct from those of other sellers or all items of that seller are prohibited.
     
  5. Clothing (Used)
    Used clothing (except underwear) can be listed on as long as it has been cleaned and the listing clearly states that the clothing is used.

    Allowed

    • Diaper Covers

    Restricted

    • Most used clothing (shirts, pants, dresses, etc.), as long as the seller states that the item is used
    • Used cloth diapers can be sold, as long as the listing states clearly that the item has been cleaned per manufacturer standards.
    • The following items, as long as there's no inappropriate content in the listing or any indication that the item was worn as underwear:
      • Bathing suits
      • Bras
      • Pantyhose
      • Spandex
      • Wrestling singlets
    • Vintage undergarments, as long as they are not modeled or recently worn

    Prohibited

    • Athletic supporters
    • Briefs
    • Boxer shorts
    • Children's sized underwear
    • G-strings
    • Jock straps
    • Thongs
    • Panties

  6. Cosmetics (Used)
    Used cosmetics present some serious health and safety concerns because the products and applicators used to apply them often come into direct contact with the body. This is why we generally don't allow the sale of used cosmetics on Craft Is Art.

    Allowed

    • New cosmetic brushes and applicators

    Restricted

    • Used cosmetic brushes, as long as they have been thoroughly cleaned
    • Homemade cosmetics, as long as they comply with FDA regulations
    • Lotions, perfumes, and body washes, as long as they don't have an applicator that comes into contact with the body
    • Opened but unused cosmetics, as long as the seller clearly states that the container has been opened
    • Sample cosmetics, as long as they come in the original container that includes the ingredient list

    Prohibited

    • Strivectin
    • Used cosmetics
    • Used makeup sponges or applicators

  7. Drugs and Drug paraphernalia
    Any drugs, drug-like substances, narcotics, steroids, and all other controlled substances aren't allowed on Craft Is Art.

     Allowed

    • Tobacco pipes made from wood, ceramic, or stone as long as you don't refer to it being used for illegal drugs
    • Milk glass pipes
    • Regular cigarette papers
    • Kitchen herb grinders
    • Peace pipes

    Restricted

    • Collectible antique glass syringes and needles can be listed as long as the seller clearly states in the listing that the item is collectible and not intended for use.
    • These items can be listed as long as the listing doesn't indicate that the item is drug related or can be used with an illicit drug:
      • Hookahs as long as they are 18" or more in height
      • Incense

    Prohibited

    • Pipes made from metal, acrylic, glass, plastic, or ivory
    • Water pipes, chamber pipes, carburetor pipes, electric pipes, ice pipes, bongs, chillums
    • Hookahs shorter that 18" in height
    • Dugout pipes and one-hitters
    • Pipes described as being used to smoke peyote or opium, regardless of age

  8. Firearms, weapons and knives
    Knives are the only items currently allow on Craft Is Art, please review the policies below for more information. Most weapons can't be listed on Craft Is Art because of strict federal and state government regulations and international laws banning the sale of these items.
     

    Allowed

    • Folding pocket knives
    • Katana or stick swords
    • Oversized balisong knives—the kind that require 2 hands to open
    • Tactical daggers
    • Throwing knives

    Restricted

    • Practice balisong or butterfly knives that have holes in the blade and can't be sharpened
    • Spring-assisted knives. There has to be manual movement of the blade by a thumb stud or screw that's clearly visible on the blade.

    Prohibited

    • Automatic knives
    • Balisong knives
    • Butterfly knives
    • Dual-action knives
    • Gravity knives
    • Hidden or disguised knives such as air gauge knives, belt buckle knives, lipstick case knives, or writing pen knives
    • Out-the-front (OTF) knives
    • Paratrooper knives
    • Push knives—they're also called push daggers, punch daggers, punch knives, push dirks, and T-handled knives
    • Replica or imitation switchblades
    • Shuriken
    • Switchblade knives (knives with a blade that open automatically—for example, by pressing a button or through inertia or gravity)
    • Sword canes


  9. Food Items
    Before listing food items, be sure to familiarize yourself with federal and state laws and regulations.

    Allowed

    • Wild morel and shitake mushrooms

    Restricted

    • All food items must have been stored safely prior to shipment and follow all storage directions on the item's packaging
    • All food and related products should be packaged or sealed to ensure that the buyer can tell if they have been tampered with

    Prohibited

    • Listings containing drug claims
    • Non-pasteurized dairy products
    • Fruit or vegetable juice that hasn't been heat pasteurized
    • Wild mushrooms
    • Akee fruit (including seeds)


  10. Healthcare Items
    Before selling healthcare or hygiene-related products, be sure to review the relevant information on the FDA's website.
     

    Allowed

    • Unexpired personal hygiene products
    • New/unopened personal hygiene and cosmetic applicators

    Restricted

    • All healthcare and personal hygiene items must be delivered to buyers before the clearly marked expiration or "use by" date. All listings for these items are required to show the expiration date in the listing.

    Prohibited

    • Drugs, drug-like substances, drug paraphernalia

  11. Motor vehicles (automobiles, motorcycles, boats, etc.)
    These listings are prohibited on Craft Is Art

  12. Plants and Seeds
    Sellers can list plants and seeds as long as they're allowed in the location they want to sell.

    Sellers need to check with their state and local authorities to see if the items are legal to sell. Review the state-by-state list of regulated noxious weeds, pests, and quarantined items, and consult with the state and local authorities to determine whether the items intended for buying and selling are legal in your state.

  13. Real Estate
    Real Estate listings are not allowed on Craft Is Art

  14. Tobacco
    Tobacco listings are prohibited on Craft Is Art. See “Drugs and Drug paraphernalia”

3.    TRANSACTIONS

Craft Is Art's role as a venue is to connect the buyer and the seller. This means when you place an order on Craft Is Art, you are entering into a direct transaction with an individual seller. We encourage the two parties to independently work through the transaction to completion.

A transaction is created when a buyer completes Craft Is Art's checkout process. The seller and buyer will receive email notification from Craft Is Art with information about the transaction along with the corresponding email notification from the selected payment gateway (applicable only when using an automated payment gateway such as PayPal, Authorize.Net, etc). A transaction is completed when the buyer pays and the seller ships the item.

The seller is obligated to ship the order or otherwise the transaction with the buyer in a prompt manner once payment has been received. The buyer is obligated to pay the order's total amount in full.

  1. Members Privacy.
    As part of a transaction you may obtain personal information, including email address and shipping information from another member. This information shall only be used for effects of that transaction or for communication with Craft is Art.
     
  2. PayPal/Amazon transactions.
    Users who choose to pay a seller with PayPal or Amazon Payments using Craft Is Art checkout system are required to submit payment before a transaction gets processed.
     
  3. Credit Card transactions directly on Craft Is Art
    Craft Is Art has partnered with different payment gateway providers companies to allow our sellers to accept credit cards directly on Craft Is Art without the buyers ever leaving the website (like PayPal, Amazon Payments and/or Google Checkout).
     
  4. Google Checkout transactions.
    Users who choose to pay a seller with Google Checkout using Craft Is Art checkout system are not required to submit payment before a transaction gets processed due to the complexity of the Google Checkout Shopping Cart Integration.

    Google Checkout transactions that need to be cancelled by the seller for any reason are not entitled to refunds for any sales commissions incurred, unless the transaction was verified by Craft Is Art through the Google Checkout API Callback URL, which needs to be set up by the seller in their Google Checkout account.

  5. Other Payment Method Transactions.
    Other Payment methods available for sellers on Craft Is Art are: Money Order, Check and “Other”, transactions processed using any of these payment methods are not entitled to refunds for any sales commissions incurred under any circumstance. Sellers should use these methods at their own discretion.

  6. Feedback
    Feedback is a way to establish a reputation of trust for buyers, sellers and Craft Is Art as a marketplace. For every transaction, the buyer and seller have the opportunity to submit a rating (from 1 to 5, being 5 an excellent transaction) and an optional comment. Both buyer and seller have the opportunity to submit feedback for up to 120 days after the date of the transaction or until the transaction is canceled by the seller (for void or invalid transactions).
     
  7. Feedback Change and Review
    Both sellers and buyers have the opportunity to change the rate and/or comments of a previously posted feedback provided both parties are in agreement to do so. Feedback Change and Review is not available for cancelled orders/transactions.

    Members may ask Craft Is Art to review feedback for removal. Contact Support to request a feedback review. Craft Is Art does not investigate the validity of opinions or statements made in feedback or mediate feedback disputes. At Craft Is Art's discretion and without notice to both parties involved, feedback may be removed or altered by Craft Is Art.
     
  8. Non-Payment
    Non-payment occurs when a buyer does not or cannot complete payment after a transaction has been created. The seller may invoice the buyer in an attempt to collect payment before shipping.

    The seller may cancel a transaction for non-payment when applicable (see Transaction cancellation).
     
  9. Transaction Cancellation
    On occasion, a seller may need to cancel an invalid or void transaction. Only the seller in a transaction may cancel the transaction. Item returns are subject to the individual seller's shop policies; the buyer needs to contact the seller for approval prior to shipping an item back to the seller. The seller may not cancel a transaction for the purpose of avoiding fees or feedback.

    As established previously, sellers are not entitled to refunds for any sales commissions incurred if the payment method selected was Google Checkout (not verified), Check, Money Order and Others (i.e. wire transfer, direct bank deposit, etc).
     
  10. Non-Delivery Cases
    A buyer can file a complaint for Non-Delivery should the seller fails to deliver an order in time and/or not delivered at all. Shipping and delivery times are defined in the seller’s own policies. Some sellers may take more time than other to deliver an order due to the fact that some items are made to order.

    Non-Delivery cases are filed through Craft Is Art. The support staff will then determine if the case proceeds or not.

    Sellers must resolve each Non-Delivery case to avoid penalties and account suspension and/or termination.

    Non-Delivery cases usually proceed or otherwise are approved when the order/transaction in question has been pending for at least 14 days for orders within the same country. For international orders (seller and buyer in different countries) this time is extended to 21 days. These times may vary depending on the seller’s shipping policies at the time of purchase.
     
  11. Buyer Contact Request
    A BCR (Buyer Contact Request) is a petition filed by the buyer requesting Craft Is Art to contact a seller directly. These requests proceed or otherwise are approved when the seller has not responded to a buyer about an order/transaction that was placed at least 3 days from the day of the request.

  12. Penalties
    1. Sellers with one (1) unresolved Non-Delivery case will be removed from any promotion and/or locked-in Premium fees.
    2. Premium sellers with three (3) unresolved Non-Delivery cases will be charged $2.00 USD monthly or $12.00 USD yearly according to their membership. Penalty fees can be reverted after reviewing the seller’s account for good standing after 6 months.
    3. Basic sellers with three (3) unresolved Non-Delivery cases will be charged a flat penalty fee of $15.00 USD. An increase of 5% will be added to the current seller’s sales commission fee, this can be reverted after reviewing the seller’s account for good standing after 6 months.
    4. Sellers with four (4) or more unresolved Non-Delivery cases will be cancelled indefinitely.
    5. Sellers with five (5) or more Buyer Contact Requests will be cancelled automatically.

4.    SHIPPING

  1. Automatic Shipping
    When listing an item, members have the option to select "Automated Shipping Calculation" for each item listed. When a seller selects this option for an item, the seller is required to provide accurate information for proper calculations, such information is, but may not be limited to: a United States five digit valid zip code from where the item is being shipped, item weight in pounds (lbs) including packaging and an optional handling fee.

  2. Automatic Shipping via UPS (United Parcel Service)
    Neither Craft is Art nor UPS are responsible for inaccurate shipping fees provided due to the seller's failure to provide the UPS Automated Shipping System via Craft is Art with correct information for proper rates calculations.

    Packaging type provided to the UPS Automated Systems by Craft is Art on behalf of the seller is "My Packaging", which is the standard custom packaging for shippers. Craft is Art does not provide support for any other UPS branded packaging types, therefore shipping fees returned by UPS are quoted based on "My Packaging" as the packaging type, the total weight and the U.S. origination zip code provided by the seller. For more information on packaging, please visit the UPS site http://www.ups.com/content/us/en/resources/ship/packaging/guidelines/how_to.html Craft is Art is able to provide buyers with a shipping fee (using the UPS Automated Shipping System) based on their shipping information, regardless of the destination country except on the case of countries where UPS does not ship to and as long as the shipping information is accurate.

    Available UPS Shipping services returned by the UPS Automated Systems when shipping to a United Stated destination are: UPS Next Day Air, UPS Second Day Air, UPS Ground, UPS Worldwide Express, UPS Worldwide Expedited, UPS Standard, UPS Three-Day Select.

    For more information on UPS shipping rates visit http://www.ups.com Seller is obligated to ship the order using the UPS shipping service selected by the buyer, or otherwise refund the buyer all applicable fees incurred due to the selection of a UPS shipping service. Should the order be shipped by another carrier or method, the seller must refund the buyer the difference in the price from the selected shipping carrier and/or method to the new one. If the difference resulted negative (new shipping method is cheaper), the buyer is not responsible for paying any extra fees incurred by the change. Free Shipping option is provided AS IS, the seller ultimately decides which UPS Shipping Service to use to ship the order if the buyer selects the Free Shipping option, however, seller is not obligated to ship the order by UPS if a UPS Shipping Service was not selected at the time of checkout or if "Free Shipping" was the selected option.

  3. Automatic Shipping via USPS (United States Postal Service)
    Neither Craft is Art nor USPS are responsible for inaccurate shipping fees provided due to the seller's failure to provide the USPS Automated Shipping System via Craft is Art with correct information for proper rates calculations.

    Seller is obligated to ship the order using the USPS shipping service selected by the buyer, or otherwise refund the buyer all applicable fees incurred due to the selection of a USPS shipping service. Should the order be shipped by another carrier or method, the seller must refund the buyer the difference in the price from the selected shipping carrier and/or method to the new one. If the difference resulted negative (new shipping method is cheaper), the buyer is not responsible for paying any extra fees incurred by the change.

    Free Shipping option is provided AS IS, the seller ultimately decides which USPS Shipping Service to use to ship the order if the buyer selects the Free Shipping option, however, seller is not obligated to ship the order by USPS if a USPS Shipping Service was not selected at the time of checkout or if "Free Shipping" was the selected option.

  4. Custom Shipping.
    Sellers have the option to set up custom shipping costs for shipping their items. Custom shipping costs are applied to each item individually. There are two types of custom shipping costs: Primary and Secondary.

    Primary Shipping Cost is the price for shipping an item alone; a Secondary Shipping Cost may be added to the item/profile to specify a different price for shipping an item with another item from the same seller. Secondary Shipping Cost is optional.

    Sellers are required to maintain shipping costs available in their account, whether as a shipping profile and/or for each item individually.
